Here is a two-paragraph entry today from Howard Blashman's "How Appealing" blog:
"'Scalia Says Confirmation Too Politicized': The Associated Press provides this report.
"And NY1 reports here that 'Final preparations are being made for this year's [Columbus Day Parade] festivities, which will feature U.S. Supreme Court Justice Antonin Scalia as Grand Marshal.'"
Letterman or Leno could not have made that up if they tried. On the one hand, Scalia objects to the politicization of the courts. On the other hand, he is marching in a parade down Broadway as if he were running for office. Yes, he is an Italian-American with distinguished accomplishments, but to hear Scalia complain about too much politicization of the judiciary is like hearing Eminem complain about too much vulgarity in rap music.
Those who heard Scalia speak at Lewis & Clark College a few years ago will never forget his solemn proclamation that the Equal Protection Clause was never intended to apply to election law issues, and that as an originalist he could therefore never vote to sustain an Equal Protection challenge in an election context. This was a few months after he had voted to stop the recount of the Florida presidential vote, precisely on Equal Protection grounds. The only possible response to Scalia's comment was laughter.
